Guidelines for In-Person Hearings and Mediations
Protocol
- These guidelines are in place for hearings and mediations, when all or some of the parties are appearing in-person.
- The Board (represented by the Industrial Relations Officer or by the Decision Makers) will discuss the guidelines before the hearing or the mediation and may make changes in response to the circumstances of each case and according to current public health guidelines.
- The Board’s representative will endeavour to hold in-person mediation or hearings in the largest available meeting room, to allow for maximum physical distancing.
- Wearing masks is recommended, particularly when physical distancing cannot be maintained and in public areas. Medical masks are available in the meeting rooms.
- For hearings, as is the normal practice, witnesses should wait outside of the hearing room until they are invited to testify.
- Persons who are ill or symptomatic should not attend the hearing or mediation. If the hearing or mediation needs to be cancelled, the Board’s representative must be notified as soon as possible.
- Regular hand washing - and use of hand sanitizer when soap and water are not available - are also recommended. Hand sanitizer is available in the meeting rooms.
- Disinfectant wipes are available in the meeting room to wipe down surfaces before or after the hearing or mediation.
