Public Notice

In the matter of the Canada Labour Code (Part I–Industrial Relations) and an application filed pursuant to Section 87.4(4) thereof involving a question respecting the application of section 87.4(1) by Canadian Union of Public Employees, Local 8111, applicant; Canadian North Inc., respondent. (040503-C)

The Canada Industrial Relations Board (Board) is providing potentially affected groups, organizations, institutions and users of the Canadian North Inc. airline with an opportunity to file submissions in CIRB matter 040503-C, described above involving a question respecting the application of section 87.4(1).

Section 87.4(1) of the Code provides that: “During a strike or lockout not prohibited by this Part, the employer, the trade union and the employees in the bargaining unit must continue the supply of services, operation of facilities or production of goods to the extent necessary to prevent an immediate and serious danger to the safety or health of the public.”

The Board will be analysing these issues during a hearing to be held between November 18, 2026, and December 2, 2026.

Among the questions to be addressed during the hearing are the following:

  1. Whether and to what extent a reduction in service would cause an immediate and serious danger to the safety or health of the public;
  2. What alternatives, if any, Canadian North’s users have for their transportation needs;
  3. In the event that the Board finds that some reduction in services delivered by Canadian North is possible without causing an immediate and serious danger to the safety or health of the public, what level of services or operations must continue during a work stoppage in order to prevent such an immediate and serious danger to the safety or health of the public.

Given its role in preventing an immediate and serious danger to the health and safety of the public, the Board is providing an opportunity for potentially affected groups, organizations, institutions and users of the Canadian North Inc. airline to make submissions on these matters.

Submissions must provide specific details in support of the statements being made and must be limited to the issues raised in this notice. They must also include the name and contact information of the person making the submission. Please note that all submissions received will be transmitted to the employer and the trade union for their review and comment. The submissions will be part of the public record.

Submissions may be submitted through the CIRB Web Portal – E-Filing and must clearly indicate the relevant Board file number in the subject line.

The timelines to address and issue a decision in respect of an application of s. 87.4 of the Code (Maintenance of Activities in the event of a strike or lockout) are strict. As such, the Board requires submissions to be filed on or before Friday November 13, at 5PM EST, and this deadline will not be the subject of any extension.
